Terms of Service
ShopSpark helps sellers prepare and manage listing content. Sellers remain responsible for reviewing every output and for the products, claims, media, and listings they publish.
1. Agreement and eligibility
By accessing or using ShopSpark, you agree to these Terms. You must be at least 18 and legally able to enter this agreement. Business users must have authority to bind their business.
2. The service
ShopSpark provides product-photo analysis, listing text and image generation, draft management, optimization, bundle planning, and optional Etsy API integration. Features may change or have limits. ShopSpark does not guarantee sales, search placement, marketplace approval, or uninterrupted service.
3. Accounts and connected services
Users must provide accurate information and protect account access. Connecting Etsy authorizes ShopSpark to use the permissions shown in Etsy's OAuth flow for seller-requested actions. Access may be disconnected or revoked. Etsy access is limited to ShopSpark engineering users during private approval testing and will not be offered publicly until individual OAuth connection and revocation controls are enabled.
4. Seller content and responsibilities
Sellers retain ownership of submitted content and grant ShopSpark only the license needed to operate, secure, and support the service. Sellers must have the necessary rights, review all generated text and media, make accurate claims, follow intellectual-property and consumer-protection rules, and maintain important source files.
5. AI-generated output
AI output may be inaccurate, incomplete, or similar to other output and must be evaluated before use. ShopSpark does not promise that output is unique, error-free, non-infringing, or fit for a specific purpose and does not claim ownership of output delivered to the seller where permitted by law.
6. Acceptable use and prohibited products
ShopSpark may not be used for illegal, deceptive, counterfeit, infringing, harmful, or abusive activity; unauthorized account access; security bypass; fake reviews; or products or content prohibited by Etsy's Prohibited Items Policy, Creativity Standards, or other applicable marketplace rules. Marketplace-eligibility and safety checks will be required before public Etsy publishing is enabled, but sellers retain responsibility for compliance.
7. Etsy and third-party services
Etsy and other providers are independent services governed by their own terms. The term “Etsy” is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc. ShopSpark is the independent Application Developer, is solely responsible for the service, and is not provided or warranted by Etsy or its affiliates.
8. Plans and payments
Current plans, usage, and prices are displayed in the service. Users are not charged unless the amount is presented and authorized. Renewal and cancellation terms will be shown before any recurring billing.
9. Suspension, termination, and deletion
Access may be limited to protect the service, comply with law, address security or payment risk, or investigate material violations. Users may stop at any time and request account and associated-data deletion from their account email by contacting support.
10. Disclaimers and liability
To the extent allowed by law, ShopSpark is provided “as is” and “as available” without implied warranties and is not liable for indirect or consequential damages, marketplace actions, provider failures, or business decisions based on generated output. Liability that cannot legally be excluded remains unaffected.
